Terms of Service
Last updated: August 4, 2026. By accessing or using Vidsy, you agree to these terms.
1. The service
Vidsy provides software to create personalized video outreach experiences, manage contacts and campaigns, capture public website context, track engagement, and integrate with third-party tools. Features may vary by plan and configuration. We may change, suspend, or discontinue features with reasonable notice when practical.
2. Accounts and workspaces
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account and workspace. Workspace owners control seats, roles, billing, and data retention for that workspace.
3. Acceptable use
You agree not to:
- Use Vidsy for unlawful spam, phishing, harassment, fraud, or deceptive practices
- Violate anti-spam, privacy, or telemarketing laws in jurisdictions you target
- Upload malware, attempt to breach security, or overload the service
- Scrape or copy the product beyond normal use of your own campaigns
- Misrepresent your identity or affiliation to prospects
- Process special-category data without a lawful basis and appropriate safeguards
We may suspend accounts that create risk for prospects, infrastructure, or other customers.
4. Your content and prospect data
You retain ownership of videos, contacts, scripts, branding, and other content you upload (“Customer Content”). You grant Vidsy a limited license to host, process, transmit, and display Customer Content solely to provide the service.
You represent that you have all rights and notices required to process prospect data (including website URLs and emails) and to send personalized outreach. You are the controller of prospect data you import; Vidsy acts as a processor/service provider for that data.
5. Third-party services
Optional integrations (email sequencers, CRMs, AI video, capture providers, analytics tags, calendars) are governed by those providers’ terms. Vidsy is not responsible for third-party outages, policy changes, or data handling outside our control. API keys and connections you add remain your responsibility to rotate and revoke.
6. Plans, fees, and taxes
Free and paid plan limits are described on the Pricing page and in-product Settings. Paid subscriptions renew until canceled. Fees are charged via our payment processor. Taxes may apply. Unless required by law, fees are non-refundable once a billing period starts. Downgrades take effect at period end or as shown in the billing portal.
7. Intellectual property
Vidsy, its software, branding, and documentation remain our property. These terms do not grant you rights to our trademarks or source code beyond using the hosted service.
8. Confidentiality
Each party may receive non-public information from the other. Recipients will use that information only to perform under these terms and protect it with reasonable care, except for information that is public, independently developed, or required to be disclosed by law.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE specific reply rates, deliverability of third-party email, or uninterrupted availability.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDSY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (OR $100 IF YOU ARE ON A FREE PLAN).
11. Indemnity
You will defend and indemnify Vidsy against claims arising from your Customer Content, outreach campaigns, prospect data practices, or violation of these terms or applicable law.
12. Termination
You may stop using the service at any time. We may suspend or terminate access for material breach, non-payment, or risk of harm. Upon termination, your license to use the service ends. Sections that by nature should survive (including IP, disclaimers, liability limits, and indemnity) survive termination.
13. Governing law
These terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Courts in Delaware have exclusive jurisdiction for disputes, subject to those protections.
14. Changes
We may update these terms by posting a revised version with a new “Last updated” date. Material changes that adversely affect paid customers will be announced with reasonable advance notice when practical. Continued use after the effective date constitutes acceptance.
